These Terms and Conditions constitute a legally binding agreement between you and Trail Bliss Nepal Pvt. Ltd. (hereinafter referred to as “the Company”, “we”, “us”, or “our”).

1. Assumption of Risk

Trekking, mountaineering, adventure activities, and vehicle travel in Nepal involve significant inherent risks, including but not limited to altitude sickness, serious injury, illness, death, natural disasters, extreme weather, landslides, avalanches, wildlife encounters, and remote medical access limitations.

By participating in any activity organized or facilitated by us, you voluntarily assume all such risks and agree that the Company shall not be held liable except in cases of proven gross negligence or willful misconduct.

2. Mandatory Travel Insurance

Comprehensive travel insurance is mandatory for all bookings. Your policy must cover high-altitude trekking, emergency medical evacuation (minimum USD 50,000–100,000), repatriation, and personal accident. Proof of insurance may be requested before issuing permits.

3. Health & Fitness Declaration

You confirm that you are in good physical and mental health and have no medical conditions that could endanger yourself or others. You must disclose any pre-existing conditions. We reserve the right to refuse participation if we reasonably believe your health poses a risk.

4. Limitation of Liability

To the maximum extent permitted by Nepalese law, our total liability shall not exceed the total amount paid by you for the specific service. We shall not be liable for any indirect, consequential, or punitive damages. We act only as an agent for third-party service providers (hotels, airlines, transporters, guides, etc.) and bear no responsibility for their acts or omissions.

5. Booking, Payment & Cancellation Policy

• A non-refundable deposit of 30% is required to confirm any booking.
• Full payment must be made at least 30 days before departure.
• Cancellation Charges:
  • 90+ days before departure: Full refund minus USD 50 administration fee
  • 60–89 days: 50% refund
  • 30–59 days: 25% refund
  • Less than 30 days or no-show: No refund

6. Vehicle Rental Terms

For vehicle rental services, you are fully responsible for complying with all traffic laws of Nepal. You must hold a valid driving license and International Driving Permit (if required). The Company is not liable for any fines, accidents, or damages caused due to your negligence or violation of road rules.

7. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control (e.g., natural disasters, political unrest, strikes, pandemics, government restrictions, flight cancellations, etc.).

8. Governing Law & Dispute Resolution

These terms shall be governed by the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal. Parties agree to first attempt amicable resolution before legal proceedings.
